Under what matrimonial regime did I marry?

The Swiss Civil Code applies a legal system that applies if no other action is taken by the spouses, namely the regime of participation in acquests. This regime establishes two masses:
  • own property: these are property that the spouses owned before the marriage or that they acquire by inheritance or gift during the marriage;
  • Acquests: these are all the assets acquired during the marriage (usually the salary).
In the event of dissolution of the regime (divorce or death), the acquests of both spouses are shared equally between them, and each keeps his or her own property without division. Any modification of this regime must be made before a notary, who will be able to advise you according to your personal situation.
